Must register with the New York Department of State before making telemarketing calls to NY consumers. $500 nonrefundable application fee and $25,000 surety bond (or CD/letter of credit). Registration valid for two years. The out-of-state exemption was repealed — if you are calling NY consumers from any location, you must register. Businesses already licensed with a state or federal agency can claim exemption from the fee and bond (but must still register and submit proof of licensure). The Department of State actively enforces registration requirements and has issued consent orders with five-figure penalties against unregistered telemarketers.

New York does NOT require individual telephone solicitors/salespersons to register separately with the Department of State. Only the telemarketing business entity must register under GBL § 399-pp. This differs from states like Florida which require both company and individual salesperson registration. However, individual telemarketers must comply with all NY telemarketing laws — calling hours, disclosure requirements, DNC compliance — and violations by individual employees can result in enforcement against both the individual and their employer.

Apply Before Your First Call

Operating as an unregistered telemarketer in New York is a separate violation from consent or calling-hours violations. You can be penalized $2,000 per call even if every other aspect of your operation is compliant.
