Must register BEFORE making any telephone solicitations from or to Texas. A separate certificate is required for each business location. The $10,000 bond protects consumers who are harmed by seller breaches. Unlike Florida ($50,000 bond), the Texas bond amount is lower — but the DTPA exposure is potentially higher because treble damages are available. Post-SB 140, the registration requirement now applies to businesses sending marketing texts and MMS to Texas consumers, UNLESS the texts are sent with prior consumer consent (per the EIA settlement).

Texas does not require separate individual salesperson/solicitor registration. Only the seller (business entity) must register under Chapter 302. Individual employees making calls on behalf of a registered seller are covered by the business registration. This is different from Florida, which requires both company and individual registration.

Apply Before Your First Call

Operating as an unregistered telemarketer in Texas is a separate violation from consent or calling-hours violations. You can be penalized $500 per call even if every other aspect of your operation is compliant.
