New York does NOT maintain a separate state Do Not Call list. Instead, NY GBL § 399-z established a statewide registry whose numbers are transferred to the Federal National DNC Registry. Telemarketers must scrub against the Federal NDNC. NY consumers register through the DOS website or directly through the FTC. Key distinction from states like Florida: there is no separate state list to scrub — federal NDNC compliance covers both state and federal DNC obligations. However, GBL § 399-z imposes its own penalty structure ($20,000/violation) on top of federal penalties for calling DNC-registered numbers. Telemarketers must also maintain entity-specific DNC lists and offer DNC opt-out at the start of every call (Nuisance Call Act, effective March 2020).

You must scrub the federal list regardless of whether New York has its own list. There is no opt-out from federal DNC compliance.
