Must register BEFORE making any telemarketing calls in Florida. License expires December 31 each year — renewal applications should be filed by mid-December to avoid a registration gap. The 10-calls-per-12-months threshold for "telephonic seller" status is very low; most businesses with any outbound calling program will qualify and must register. Individual telephone solicitors employed by the registered company must ALSO register separately ($300 each). Exemptions exist for companies making fewer than 10 calls per year or whose principal business is not telephone solicitation — but FDACS scrutinizes these claims. When in doubt, register.

Each individual telephone solicitor employed by a registered telemarketing company must register separately with FDACS. $300 per salesperson per year. The company registration and individual registrations must both be active for any given solicitor to legally make calls. Employing unregistered solicitors exposes the company to additional violations.

Apply Before Your First Call

Operating as an unregistered telemarketer in Florida is a separate violation from consent or calling-hours violations. You can be penalized $500 per call even if every other aspect of your operation is compliant.
