Additional Notes
Must register with the NJ Division of Consumer Affairs before making any unsolicited telemarketing calls to NJ consumers. Fee is tiered by call capacity: $150 (up to 5 lines), $500 (6-15), $2,000 (16+). $50,000 bond required. Applies to out-of-state callers targeting NJ consumers. Strong enforcement: $10,000/$20,000 penalties. Must display registration certificate prominently and update DNC lists every 31 days. Internal DNC records must be kept 5 years.
New Jersey does not require separate individual salesperson registration. However, individuals making calls must be employed by or associated with a registered telemarketer. The NJ statute (N.J.S.A. 56:8-121) requires all persons making unsolicited calls to be 'registered with or employed by a person who is registered' with the Division.
Apply Before Your First Call
Operating as an unregistered telemarketer in New Jersey is a separate violation from consent or calling-hours violations. You can be penalized $10,000 per call even if every other aspect of your operation is compliant.
