Overview

New Jersey has a robust telemarketing regulatory framework. The Telemarketer Registration Act (N.J.S.A. 56:8-126 et seq.) requires telemarketing companies to register with the Division of Consumer Affairs before making solicitation calls, post a $20,000 surety bond, and maintain detailed records. NJ also has its own Do Not Call list. The Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) provides the enforcement backbone — the AG can pursue penalties up to $10,000 per violation, and treble damages are available for willful violations. NJ courts have been active in telemarketing enforcement. Private right of action exists under the CFA. Automated calls to NJ consumers require prior consent under both state and federal law.

NJ's approach targets the entire call chain: the telemarketer (civil + criminal penalties), the lead generator (Consumer Fraud Act), the VoIP provider (multistate litigation), AND the carriers that deliver the calls to consumers.

Fluent LLC (consent farm / lead generator)

FTC sued NY-based Fluent LLC as part of Operation Stop Scam Calls for tricking consumers (including NJ residents) into "consenting" to robocalls through deceptive lead generation websites. Fluent collected consumer data via gift card promotions and sold it as telemarketing leads.
