Telemarketers must register with the state and maintain a Do Not Call list. The Telemarketing and Telephone Solicitation Act governs operations. Penalties: civil penalties up to $5,000 per violation; willful/knowing violations are a Class D crime with fines up to $10,000 and/or imprisonment up to 1 year. Private lawsuits may recover up to $5,000 per violation plus attorney fees. Maine requires telemarketer registration with a surety bond.
