Must register with the Arkansas Secretary of State at least 10 days before transacting business. Arkansas has one of the lowest registration fees ($10) and bond amounts ($10,000) in the country. Exemptions apply to sellers of securities, financial institutions, insurance sellers, and those making solicitations without intent to complete a sale over the phone. Willful violations are misdemeanors enforceable by the Attorney General.
Arkansas does not require separate individual salesperson registration. Only the telephonic seller (business entity) must register with the Secretary of State. Note: There is a separate registration process for professional telemarketers working for paid solicitors in the charitable solicitation context (Form PT-01), which does require individual registration at $10 per person.
Apply Before Your First Call
Operating as an unregistered telemarketer in Arkansas is a separate violation from consent or calling-hours violations. You can be penalized $10,000 per call even if every other aspect of your operation is compliant.
