Arkansas's state Do Not Call list was merged into the federal National DNC Registry after its establishment. Registering on the federal list provides protections under both federal and Arkansas DNC laws. Under Ark. Code Ann. §§ 4-99-101 through 112, telephonic sellers must register with the Arkansas Secretary of State at least 10 days before soliciting, with annual renewal. A surety bond running in favor of the Secretary of State is required. The AG enforces violations under the Arkansas Deceptive Trade Practices Act (ADTPA). Penalties: up to $5,000 per violation (first offense), $10,000 for subsequent violations. Using automated dialing systems to play recorded messages without consent is a Class D felony.
