North Dakota Do-Not-Call List
State DNC registry requirements for North Dakota
You must scrub against BOTH the federal National DNC Registry AND the North Dakota state DNC list before making calls in this state. Scrubbing only the federal list is not sufficient.
North Dakota Do Not Call List (adopted federal NDNC)
Covers
North Dakota adopted the FTC National DNC Registry as its state Do Not Call list under NDCC Chapter 51-28. Consumer registration covers both state and federal protections. The list applies only to personal phones, not business phones. There is NO state telemarketer registration requirement in North Dakota. Penalties: AG may impose civil penalties up to $2,000 per violation; private right of action for actual damages or $2,000, whichever is greater. Each call constitutes a separate violation. Callers may not block or circumvent caller ID. Exemptions: surveys, charities, political groups/candidates, businesses with prior relationship (within 2 years) or prior consent. Consumer registration: 1-888-382-1222 (from the number to register).
Federal National DNC Registry (Always Required)
You must scrub the federal list regardless of whether North Dakota has its own list. There is no opt-out from federal DNC compliance.
