Overview
Maryland regulates telemarketing through the Maryland Telephone Solicitations Act (Md. Code, Com. Law § 14-2201 et seq.) and the Maryland Telephone Consumer Protection Act (Md. Code, Com. Law § 14-3201 et seq.). The state maintains its own Do Not Call list through the Office of People's Counsel. Maryland does NOT have a mini-TCPA with a private right of action — enforcement is handled by the Attorney General and can impose penalties up to $10,000 per violation. Telemarketers must register with the state before soliciting Maryland consumers. Federal TCPA and FCC rules remain the primary private litigation vehicle for Maryland consumers.
