Overview

Massachusetts regulates telemarketing through the Telemarketing Solicitation Act (M.G.L. c. 159C) and 201 CMR 14.00 regulations. The state maintains its own Do Not Call list through the Division of Telecommunications and Cable. While Massachusetts does not have a dedicated mini-TCPA, the state's powerful Consumer Protection Act (M.G.L. c. 93A) provides a private right of action with treble damages for unfair or deceptive telemarketing practices — making Massachusetts one of the highest-risk states for telemarketing violations even without a mini-TCPA. A 30-day notice-and-cure demand letter is required before filing suit under c. 93A.
