Overview

Idaho does not have a mini-TCPA statute. Telemarketing is regulated under the Idaho Telephone Solicitation Act (Idaho Code §§ 48-1001 through 48-1011). The state does not maintain its own Do Not Call list — Idaho relies on the federal National DNC Registry. Telemarketers must register with the AG's office before soliciting Idaho consumers. No private right of action exists for telemarketing violations — enforcement is through the AG. Federal TCPA and FCC rules are the primary framework for consent and automated calling requirements. Idaho is a relatively low-regulation, low-litigation state for telemarketing, but compliance with federal rules and state registration is mandatory.
